These General Terms of Use, hereinafter the "Terms", define the rules for accessing and using the recruitment and professional referencing space made available by APPM RH.

1. Purpose

These Terms define the rules for accessing and using the recruitment and professional referencing space made available by APPM RH. This space allows in particular:

  • candidates to submit an application;
  • professionals to register in APPM RH's CV database;
  • service providers to request their referencing;
  • craftspeople, consultants and liberal professions to present their skills;
  • companies, firms, cooperatives and professional groups to present their services;
  • APPM RH's client companies to search for profiles and skills matching their needs.

Using this space implies acceptance of these terms.

2. Publisher identification

3. Definitions

In these terms:

  • User: any natural or legal person accessing the platform or using one of its services.
  • Candidate: any natural person submitting their CV or file to seek a job, assignment, internship, training or professional opportunity.
  • Service provider: any natural or legal person offering products, works, advice, supplies or professional services.
  • Liberal profession: any person independently carrying out an intellectual, legal, technical, medical, accounting, financial or similar activity, subject to the applicable professional authorizations.
  • Craftsperson: any natural person or structure primarily carrying out a manual, technical, manufacturing, repair, installation, construction or maintenance activity.
  • Consultant: any natural or legal person offering expertise, study, advisory, training, assistance or professional support services.
  • Professional group: any association, cooperative, organization, collective enterprise or grouping of professionals carrying out one or more trades.
  • Client company: any company, institution, organization, administration, association or other structure using APPM RH's services.
  • Referencing: the registration and classification of a professional or structure in APPM RH's database after review of their file.

4. Acceptance of the terms of use

The user acknowledges having read these Terms before submitting their file. Acceptance may be evidenced by:

  • a checkbox;
  • a handwritten signature;
  • an electronic signature;
  • validation of the registration form;
  • or any other action clearly indicating the user's agreement.

The acceptance box must not be pre-checked. In case of disagreement with these terms, the user must refrain from using the recruitment and referencing space.

5. Conditions of access to the service

Access to the registration form is in principle open to any person with the capacity to provide accurate professional information. Minors must not register without the authorization of their legal representative, except within a legal apprenticeship, internship or training scheme.

The user must have:

  • internet access when using the online platform;
  • a valid email address or phone number;
  • the documents needed to present their profile;
  • the capacity or legal authorization to carry out the declared activity.

6. Creating an account

Where the platform provides for the creation of an account, the user must provide accurate and up-to-date information. It is their responsibility to:

  • protect their login and password;
  • not share their password with a third party;
  • log out after using a shared device;
  • inform APPM RH in the event of fraudulent use of their account;
  • regularly update their contact details;
  • spontaneous applications without opening an account are also accepted.

Any action carried out from the user's account may be considered as having been performed by them, unless prior notice of fraudulent use is given. APPM RH may suspend an account when it detects a risk of fraud, unauthorized access or a breach of these terms.

7. Accuracy of the information provided

The user undertakes to provide accurate, sincere, complete, legible, up-to-date and verifiable information. In particular, they must not:

  • use a false identity;
  • falsify a diploma or certificate;
  • fraudulently modify a work certificate;
  • present non-existent experience;
  • usurp the name of a company or professional;
  • provide false references;
  • declare an approval, authorization or qualification they do not hold;
  • use the work or achievements of a third party as if they were their own.

Any false declaration may result in the rejection of the file, suspension of referencing or permanent deletion of the profile, without prejudice to any action that may be taken.

8. Information and documents requested

Depending on the profile, APPM RH may request, among others: a curriculum vitae, a professional presentation, the candidate or provider contact details, diplomas and certificates, training certificates, work certificates, professional references, certificates of satisfactory completion, professional authorizations or approvals, the structure registration information, the RCCM, the tax identification number, the group articles or receipt, the list of services offered, areas of operation, human and material resources, photographs or examples of work, availability and indicative rates.

APPM RH endeavors to limit collection to information necessary for recruitment, evaluation or referencing. Certain sensitive documents, such as a full identity document or bank details, may be requested only at a later stage when they are necessary for verification, contracting or payment.

9. Verification of information

The user authorizes APPM RH, within the limits set by the privacy policy, to verify the professional information provided. This verification may relate in particular to the declared identity, the authenticity of diplomas, certificates and qualifications, previous positions held, assignments carried out, certificates of satisfactory completion, professional references, administrative authorizations and the legal existence of the company or group.

APPM RH may request additional information or documents before validating a file. The user must be informed before any contact with their current employer, except where such verification results from a legal obligation or prior agreement already given.

10. Referencing of service providers

Submitting a file does not mean the provider is automatically referenced. Referencing may be subject to the receipt of a complete file, verification of documents, an interview, a visit to the workshop or premises, verification of references, a technical test, the presentation of samples, the provider administrative compliance, or acceptance of a quality or ethics charter.

APPM RH may classify providers according to their trade, experience, area of operation, available resources, references and level of verification.

11. No guarantee of employment or contract

Registration in the CV database or the provider directory constitutes neither a promise of hiring, nor a guarantee of assignment, nor a reservation of a position, nor a guarantee of consultation, nor a promise of contract, nor a guarantee of turnover, nor any exclusivity granted to the candidate or provider.

APPM RH contacts profiles based on the needs expressed by client companies, the match between skills and the opportunity, technical criteria, availability, location, experience, financial terms and the specific requirements of each assignment. The final recruitment or selection decision may belong to the client company.

12. No exclusivity

Unless otherwise agreed in writing, registration with APPM RH is not exclusive. The candidate or provider remains free to seek other opportunities, work with other agencies, offer their services directly to other companies or decline an opportunity presented by APPM RH.

Likewise, APPM RH remains free to reference several professionals in the same field.

13. Transmission of profiles to client companies

When an opportunity matches the user's profile, APPM RH may transmit to a client company the professional information necessary to review the file: the CV, skills, experience, diplomas, references, availability, area of operation, professional resources and the technical or financial proposal.

The transmission of direct contact details, identity documents or other particular data must be limited to what is necessary. Where the person's consent is required, APPM RH must obtain it before transmission.

14. Introduction and connection

APPM RH may organize the connection between a client company and a candidate or provider. This connection may take the form of an interview, a meeting, a technical visit, a request for a quote, a restricted call for tenders, a trial assignment, a professional test or a request for a technical proposal.

The connection does not automatically create any contract between the parties. Any employment, service, subcontracting or supply contract must be formalized separately.

15. Non-circumvention of APPM RH

When a candidate, consultant or provider is introduced to a client company by APPM RH, the parties must respect the commercial terms agreed with APPM RH. Where provided for by a separate agreement, the client company and the provider undertake not to circumvent APPM RH in order to avoid paying fees, commissions or introduction charges.

The duration and scope of any non-circumvention obligation must be specified in a separate contract or agreement. These Terms alone are not sufficient to set the amount of a commission or to create a financial obligation not previously brought to the parties' attention.

16. APPM RH's fees and remuneration

Registration in the CV database or directory may be free or paid depending on the services offered. Any fees must be clearly announced before being invoiced. APPM RH may be remunerated through recruitment fees, personnel provision fees, referencing fees, professional subscriptions, introduction commissions, evaluation fees, management fees, or advisory or training services.

Amounts, payment terms and refund conditions must be specified in a quote, purchase order, contract or separate pricing terms. No payment shall be considered a guarantee of employment or contract.

17. Candidate's obligations

The candidate undertakes to:

  • present a truthful CV;
  • report significant changes to their situation;
  • respond to invitations or inform APPM RH of their unavailability;
  • attend interviews at the agreed time;
  • adopt professional conduct;
  • respect the confidentiality of the information received;
  • not request or make any irregular payment;
  • inform APPM RH when accepting an opportunity presented by it;
  • report any incorrect information in their profile.

No placement fee is charged to job seekers; fees are borne by the mandating client companies.

18. Service provider's obligations

The provider undertakes to have the skills advertised, comply with the laws and obligations applicable to their activity, keep their authorizations and approvals valid, comply with safety rules, provide truthful and sufficiently detailed quotes, meet contractual deadlines, employ qualified personnel, respect the agreed quality standards, protect clients property and information, take out the necessary insurance where their activity requires it, report any conflict of interest and inform APPM RH of any significant change in their situation.

The provider charges no fee to job seekers; fees are borne by APPM RH's principals.

19. Client companies' obligations

Client companies using the profiles provided by APPM RH undertake to use the information only for the relevant opportunity, preserve the confidentiality of files, not pass CVs to unauthorized third parties, not use the data for solicitations unrelated to recruitment, apply professional and non-discriminatory criteria, honor the contractual commitments made to APPM RH, provide sufficiently precise information about positions or services, inform APPM RH of the outcome of the connection, and return or delete files that are no longer needed.

20. Prohibited conduct

It is prohibited to use the platform to:

  • post false offers — for the purposes of building the CV database, offers must be anonymous and must not recruit for a specific structure;
  • fraudulently collect CVs;
  • commit fraud;
  • request unauthorized payments;
  • usurp the identity of a person or company;
  • transmit viruses or malicious files;
  • access other users' accounts without authorization;
  • automatically extract the database;
  • copy or sell profiles;
  • spread insulting, hateful, discriminatory or threatening remarks;
  • infringe the rights of a third party;
  • publish unlawful content;
  • divert the platform from its professional purpose.

21. Content submitted by the user

The user remains responsible for the texts, photographs, logos, documents, references and other content they submit. They warrant that they are authorized to submit this content, that the content does not infringe the rights of a third party, that the photographs and work presented belong to them or are used with authorization, and that the information does not breach any confidentiality obligation.

The user grants APPM RH a non-exclusive authorization to use the submitted content solely to review the file, present the profile, carry out referencing, seek opportunities and communicate the profile to authorized client companies. This authorization ends when the data is deleted, subject to legal or contractual retention obligations.

22. Intellectual property of the platform

The site, its structure, texts, visual identity, databases, forms and graphic elements belong to APPM RH or are used with authorization. Any unauthorized reproduction, extraction, modification or exploitation is prohibited.

In particular, the user may not copy the profile database, reproduce the form to create a competing service, use APPM RH's name or logo without authorization, or massively extract information from the platform.

23. Protection of personal data

Personal data is processed in accordance with APPM RH's privacy policy. This policy specifies in particular the information collected, the purposes of processing, the recipients, the retention periods, the security measures, the rights of individuals, the arrangements for withdrawing consent and the contact details for exercising these rights.

Acceptance of these Terms does not replace the specific consent required for certain processing, in particular retention in a CV database or transmission of the profile to client companies.

24. Confidentiality

APPM RH undertakes to take reasonable measures to limit access to files to authorized persons. The user nonetheless acknowledges that no computer system or electronic transmission service can be guaranteed to be entirely free of risk.

Users must also preserve the confidentiality of information received in connection with an introduction. Any technical, financial, commercial or organizational information communicated as confidential must be used solely for the evaluation or performance of the relevant opportunity.

25. Retention and updating of profiles

The user is invited to update their profile regularly. APPM RH may request periodic confirmation, classify a file as inactive, suspend an outdated profile, delete a file that has not been updated, request new supporting documents or renew a professional verification.

A prolonged absence of updates may reduce the likelihood of being contacted.

26. Suspension or deletion of a profile

APPM RH may suspend or delete a profile in the event of a false declaration, a forged document, fraudulent behavior, abusive multiple registration, a breach of these Terms, a serious complaint from a client company, seriously deficient performance, conduct contrary to professional ethics, unjustified refusal to provide verification documents, or use of the platform for unlawful purposes.

Where circumstances permit, the user may be invited to provide observations before a permanent deletion. The suspension of a profile does not relieve the parties of their obligation to honor commitments already made.

27. Reporting and complaints

Any user may report a false offer, a suspicious payment request, misuse of their CV, identity theft, a breach of confidentiality, inappropriate conduct or an error in their profile.

Reports may be sent to APPM RH – Complaints Department: email appm@groupeappm.com, telephone 76 40 49 44, address Sangarébougou, Seydoubougou sector, street 110, gate 39 (or 05). The report must contain sufficient information to allow it to be examined.

28. Availability of the platform

APPM RH endeavors to ensure regular access to the platform. Access may nonetheless be interrupted due to maintenance, an update, a breakdown, a security incident, a host failure or an event beyond APPM RH's control.

APPM RH does not guarantee that the service will be accessible without interruption or error. Where possible, significant scheduled interruptions are announced in advance.

29. Limitation of liability

APPM RH acts primarily as an intermediary, recruiter, CV-database manager or facilitator of introductions. APPM RH cannot guarantee the hiring of a candidate, the award of a contract, the solvency of a party, the perfect performance of a service, the absolute accuracy of all information provided by users, or the conclusion of a contract following an introduction.

APPM RH remains liable for its own obligations within the limits set by the applicable legislation and the agreements concluded. No clause of these Terms shall be interpreted as removing a liability that cannot legally be excluded.

30. Evaluation of service providers

After an assignment, APPM RH or the client company may carry out an evaluation covering in particular the quality of work, adherence to deadlines, the conformity of the service, safety, professionalism, communication, the fulfilment of commitments and the quality of after-sales service.

The evaluation must be objective, proportionate and based on verifiable professional facts. The provider may request the correction of factually inaccurate information.

31. Fight against corruption and irregular payments

Users, employees, candidates and providers are prohibited from offering an undue advantage, requesting a secret commission, paying money to secure a job, falsifying an invoice or quote, improperly influencing a selection or offering a gift intended to alter a decision.

Any payment due to APPM RH must be justified by an official document and made according to the terms communicated by the company. Any suspicious behavior must be reported to management.

32. Non-discrimination

Applications and referencing must be assessed according to professional criteria relating in particular to skills, qualifications, experience, availability, aptitudes, references and the legitimate requirements of the assignment.

Decisions must not be based on discriminatory criteria unrelated to the position or service.

33. Links to external sites

The platform may contain links to sites or services operated by third parties. APPM RH does not necessarily exercise control over these external services and cannot be held responsible for their content, availability or privacy practices.

The user is invited to consult the terms of use and privacy policies of the sites concerned.

34. Amendment of the terms of use

APPM RH may amend these Terms to take account of the evolution of its services, new features, changes in regulations, security requirements or the recommendations of the competent authorities.

The date of the last update must be indicated at the top or bottom of the document. Where the amendments are significant, users may be informed by email, notification or a message published on the platform. Continued use of the service after the new terms take effect constitutes acceptance, subject to the specific consents that must be obtained separately.

35. Partial invalidity

If any provision of these terms is declared invalid or unenforceable, the other provisions remain applicable. The provision concerned must, as far as possible, be replaced by a valid provision pursuing a similar objective.

36. Applicable law and dispute resolution

These terms are governed by the law applicable in the Republic of Mali. In the event of a difficulty, the parties must first seek an amicable solution.

The complaint must be sent in writing to APPM RH with the claimant identity, a description of the problem, supporting documents and the desired solution. In the absence of an amicable settlement, the dispute may be brought before the competent court, subject to the applicable legal rules. Matters relating to personal data may also be brought before the competent Malian data protection authority.
